International audienceIn the Said Shamilovich Kadzoev case (November 30, 2009, C-357/09), the Grand Chamber of the Court of Luxembourg has interpreted for the first time Directive 2008/115 of December 16, 2008 on common standards and procedures in Member States for returning illegally staying third-country nationals. Seized in urgency of a prejudicial question by the administrative Court of Sofia, the ECJ offers an apprehension of the EU law on asylum and immigration that is of major importance. The Bulgarian judge needed to know if the retention of Mr. Kadzoev in a temporary placement center placement since October 21, 2006 was compatible with the EU law.
